Welcome to Occuin. These Terms and Conditions govern your access to and use of the Occuin website, mobile applications, and services (collectively, the "Platform"). By accessing or using Occuin, you agree to be bound by these Terms. If you do not agree, please do not use our Platform.
• "Occuin," "we," "us," or "our" refers to Occuin and its operators.
• "User," "you," or "your" refers to any individual or entity accessing or using the Platform.
• "Seller" refers to any User listing animals or livestock for sale.
• "Buyer" refers to any User browsing, inquiring about, or purchasing animals or livestock.
• "Content" refers to text, images, listings, messages, and other materials posted on the Platform.
You must be at least 18 years old to use Occuin. By using the Platform, you represent and warrant that you are of legal age and have the authority to enter into these Terms. Users must comply with all applicable local, state, and federal laws regarding animal sales, transport, and ownership.
To access certain features, you must register for an account. You agree to:
• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Promptly update your account information as needed
• Accept responsibility for all activities under your account
Occuin reserves the right to suspend or terminate accounts that violate these Terms or provide false information.
You agree not to:
• Post false, misleading, or fraudulent listings
• List animals that are illegal to sell, transport, or own in your jurisdiction
• Use the Platform for any illegal purpose
• Harass, threaten, or defraud other Users
• Upload malicious code, spam, or unwanted solicitations
• Circumvent Occuin's fees or communication systems
• Impersonate any person or entity
5.1 Seller Responsibilities
Sellers are solely responsible for the accuracy of their listings, including descriptions, photographs, pricing, health status, and breed information. All animals listed must be legally owned and available for sale.
5.2 No Guarantee of Sale
Occuin does not guarantee that any listing will result in a sale. We are a marketplace platform and do not take title to or possession of any animals listed.
5.3 Prohibited Listings
The following are strictly prohibited:
• Endangered species without proper CITES documentation
• Animals obtained through illegal means
• Animals subject to active legal disputes
• Counterfeit or misrepresented breeds
• Livestock in violation of animal welfare laws
Occuin facilitates introductions between Buyers and Sellers. Unless explicitly stated otherwise, all payment terms, delivery arrangements, and contractual obligations are strictly between the Buyer and Seller. Occuin is not a party to any transaction and assumes no liability for payment disputes, non-delivery, or misrepresentation.
Occuin may charge fees for certain services, including but not limited to featured listings, premium accounts, or transaction facilitation. All fees are disclosed prior to purchase and are non-refundable unless otherwise stated.
All content on the Platform, including logos, designs, text, graphics, and software, is the property of Occuin or its licensors and is protected by copyright, trademark, and other intellectual property laws. Users may not reproduce, distribute, or create derivative works without express written permission.
User-generated content remains the property of the User, but by posting on Occuin, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your Content in connection with operating and promoting the Platform.
OCCUIN IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT ENDORSE, VERIFY, OR GUARANTEE THE QUALITY, HEALTH, OR LEGALITY OF ANY ANIMALS LISTED.
TO THE FULLEST EXTENT PERMITTED BY LAW, OCCUIN DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OCCUIN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO OCCUIN IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless Occuin and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Platform, your Content, or your violation of these Terms.
Occuin may suspend or terminate your access to the Platform at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, all licenses granted to you will cease immediately.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Occuin operates, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the courts of that jurisdiction.
We may update these Terms from time to time. Material changes will be notified via email or Platform notice. Continued use after changes constitutes acceptance of the revised Terms.
